Does FDA clearance help me in Europe (or a CE mark in the US)?

In short: No. The frameworks are legally separate: FDA clearance grants nothing in the EU, and a CE mark grants nothing with FDA. What transfers is the underlying evidence — testing, clinical data, QMS work — which is why sequencing and dossier design matter more than which badge comes first.

Why the legal separation surprises founders

It's an intuitive but wrong assumption that regulatory approval in one major market should count for something in another — after all, the underlying safety and performance questions are often similar. But FDA and the EU's Notified Body system are entirely independent legal frameworks with their own submission requirements, evidentiary standards, and review bodies. An FDA 510(k) clearance carries no formal weight with a Notified Body reviewing your CE technical file, and a CE mark carries no formal weight with FDA. Each market requires its own complete submission and its own independent determination.

What actually does transfer

The frameworks are separate, but the underlying evidence generation largely isn't wasted work twice over. Bench testing, software verification and validation, clinical data, and risk management documentation built for one market substantially reuses for the other — the submission logic built around that evidence (an MDR conformity case versus an FDA substantial-equivalence argument) has to be constructed differently, but the raw evidence doesn't need to be regenerated from scratch.

Why this changes how you plan, not just what you submit

Because the evidence transfers but the submission logic doesn't, the practical lesson is to design your evidence-generation programme for reuse from the start — building a technical file or testing plan with only one market's submission format in mind, then trying to retrofit it for a second market, generates rework that early planning would have avoided. Sequencing which market you pursue first is a strategic decision, not just a matter of which regulator is "easier."
